LEGAL COMPONENTS TO BE INCLUDED IN THE AUP

These are relatively easy to deal with and include in your Acceptable Usage Policy (AUP). Obviously, certain behaviour is clearly illegal – such as using a computer to perpetrate credit card fraud, to spread viruses, to hack into other computers, or to illegally download copyrighted materials.

Issues such as these are covered by the Computer Misuse Act 1990, the Data Protection Act and copyright legislation. The circumstances where these sanctions come into effect need to be outlined clearly within the AUP.

In your AUP you may wish to list these responsibilities in detail, or just say something broad such as "Employees are forbidden to use company computers for any form of activity considered to be illegal or fraudulent under current National and State Laws and Legislations".

If unsure, seek qualified legal advice.
